What happens from 1 October 2023 if I have a garnishment ordered by ANAF?
If until now, banks have been transferring to ANAF the amounts that have been garnished within the legal deadline of 3 working days after the establishment of the garnishment, from 1 October 2023, banks must communicate to ANAF the amounts that can be paid to the garnishments, as follows:
➤ by 5 p.m. on the next banking day following the day on which the attachment address was notified;
➤ by 17:00 on the next banking day following the day on which the amounts were debited from the customer's account.
The change applies to all banks in Romania, following the Ministry of Finance Order no. 878/2022 and applies to all customers with attachments instituted by ANAF after 01.01.2021.
Depending on the amounts reported by each bank, ANAF:
➤ It will decide from which bank accounts the attachment will be paid;
➤ Will send a message (called a payment order) to the banks to transfer the amounts.
For this reason, banks no longer transfer the amounts directly to ANAF after a garnishee has been set up, but have to wait for ANAF to order them.
Until it is received, the bank will keep the amounts to be paid in a special account named Cert Balance Account for ANAF Money. The account can be viewed in the statement and in Internet Banking applications.
Amounts in this account can no longer be released at the customer's request, and the bank cannot reduce the amount after the daily statement of amounts is sent to ANAF.
